How do we get beyond race, without considering race? The answer is succinct and straightforward... and it is expressed by the very people who drafted the 14th Amendment to the US Constitution: we don't. Through a careful examination and critical analysis of legislative history, Professor James Anderson reveals that the post-Civil War Congress never intended a color-blind application of the 14th Amendment. So, why are contemporary courts ruling otherwise? Professor Anderson meticulously connects the dots linking Dred Scott to the 14th Amendment to Plessy to Brown to Louisville and Seattle... illuminating the historical context of power and privilege in America.
